Interior Designs Terms & Conditions
When booked through Fiverr, iSCO's Interior Design Services will abide by Fiverr's Terms and Conditions:
https://www.fiverr.com/legal-portal/legal-terms/terms-of-service
When booked directly with iSCO Designs, the Term's and Conditions are as follows:
1. Detailed Specifications
The interior designer must develop the design, as agreed with the client, of all works to be done as detailed on plan and 3D drawings where applicable.
2. Scope of Work
For conceptual design, work should include floor plans, elevations, sections and 3D views. A site development plan will only be produced upon receipt of valid, legal site map from the client. It must be noted that the designer’s work is only conceptual, and does not include services from contractors like plumbing, electrical, and engineering contractors.
3. Drawings
The client must know that drawings are only conceptual and serve as a design concept and not to be used for other purposes such as for planning applications, tenders, contractors or construction. The onus also lies on the client to ensure that he or she provides accurate information to the designer.
4. Consultants and Contractors
Because a designer is not a general contractor when a contract requires the input of consultants and contractors, the client will enter in a separate contract for their services.
The designer will not provide a warranty, guarantee, or certification of their part of the project and neither will the designer be responsible for the quality of their works, materials used, their performance, nor their duration of works. However, the designer shall supervise them for conformity to his design concept.
5. Design Fees
The client must pay, according to the terms, when an invoice is presented. Upon signing the agreement, a client shall pay the designer a non-refundable 50% deposit which establishes a minimum fee for all design services. This deposit will be credited against all fees payable to the designer upon completion. The remaining 50% balance will be due on completion of design.
6. Price/Cost Guarantees
A designer cannot guarantee prices of materials or other services not performed by him or her, because vendor pricing is subject to change, and if a client is indecisive or unsure, and takes longer than is necessary to make a firm decision, a vendor’s change in price will be out of the designer’s control.
7. Reimbursable Expenses
The client agrees to reimburse the designer for any out-of-pocket expenses incurred by him or her in relation to the interior design project. This may include things like including but not drafting or renderings services, revisions, etc. Reimbursables also include site call out, travel, meal, and lodging if and where necessary, as long as it is in connection with the contract.
8. Payments and Payment Terms
Conceptual design payment terms include a 50% deposit due on the commencement of the design, and 50% balance due upon completion and delivery of the final design to the client. Invoices due more than 30 days will accrue late fee charges. All work will cease and the delivery of items withheld until all due invoices are cleared.
9. Photographing Completed Works
For the designer’s portfolio of works, the client must agree to allow the designer to photograph the project through all its stages of works and after the project is completed which simply means that there should be an agreement between the two parties for ‘before and after’ pictures. If the photographs will be used for business or publicity reasons like posting online, on social media, or for marketing and advertising, the designer must agree not to disclose the client’s name or address without prior consent.
